1. AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you and The Bear Trainer Ltd (“we," “us," or “our”), concerning your access to and use of the www.thebeartrainer.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” and "Services"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

2. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site and Services are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of the United Kingdom. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. 3. USER REGISTRATION & ACCOUNTS

You may be required to register with the Site to access the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. SERVICES AND PAYMENTS

Our services consist of online personal training and bodybuilding coaching.

Subscriptions: All our services are provided on a subscription basis. Your initial payment covers an 8-week period. Following this, your subscription will seamlessly transition to a rolling monthly payment.

Payment: We use Stripe and PayPal to process payments. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

Cancellation: Following the initial 8-week sign-up period, a four-week notice period is required to cancel your subscription.

5. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

Copy or resell your training plans, meal plans, or any other coaching materials.

Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.

6. DISCLAIMERS

THE SITE AND SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.
